Terms & Conditions of Booking
The owners of Ellis Exclusive Villas offer the property for short term rental to the guest detailed on the booking form under the terms set out below. The guest accepts these conditions on behalf of all the members of the booking party. Please read your Vacation Rental Agreement carefully before you begin your vacation, it details the terms and conditions of your booking.
Any monies received by Ellis Exclusive Villas LLC for occupancy of the vacation property indicate the acceptance of the terms of our vacation rental agreement in full. All policies are strictly enforced.
Only persons named on the booking form are entitled to use the property. It is the responsibility of all guests and members of their party to be familiar with all policies pertaining to rental.
QUOTATION: The quoted price is valid for seven days. Should you wish to proceed with the booking, please provide a 25% deposit of the full amount as soon as possible (this is a non-refundable deposit). Your chosen dates will be held for a maximum of seven days from first enquiry. The booking is not secured until the deposit is received and cleared. Until then, we reserve the right to accept any booking for the property from a third party.
RENTER REQUIREMENTS: For legal and accounting purposes, the person placing the reservation must be the same as the credit/debit card holder. This person is considered to be the guest. All other persons involved with the rental are considered to be the guest’s invitees, and all discussions regarding reservation, cancellation, and damage policies will be discussed with the guest, not the guest’s invitees. The guest understands that Ellis Exclusive Villas rents to responsible adults over the age of 21 ONLY. Only persons named on the booking form are entitled to use the property.
BASIS OF RENTAL: The named property is offered on a self-catering basis. Bed Linen & Towels are provided. Toiletries are provided for only one night. You will need to buy toilet paper, paper towels, dishwasher & clothes soap, along with other products at the local grocery store. Rates include a one-time linen & towel set up.
The property is licensed for the maximum occupancy as stated on the property listing. Please note that NO ANIMALS OF ANY DESCRIPTION ARE ALLOWED IN THE PROPERTY AT ANY TIME UNLESS STATED ON THE PROPERTY DESCRIPTION ON OUR WEBSITE.
CONDITION AND USE OF PROPERTY: The Property is provided in “as is” condition. Ellis Exclusive Villas shall use its best efforts to ensure the operation of all amenities in the Property, such as internet access, satellite or cable TV access or hot tubs, fireplaces as applicable. We shall not be held responsible for such items failure to work, but will make every effort to correct any issues as reported as quickly as possible. The guest acknowledges that use of amenities such as hot tubs, pools, spas, fireplaces, decks, and the like may be potentially dangerous and involve potential risks if improperly used, particularly with regard to children and such use is at the guest’s own risk.
The guest shall use the Property for residential purposes only and in a careful manner to prevent any damage or loss to the Property and keep the Property in clean and sanitary condition at all times. The guest and any additional permitted guests shall refrain from loud noise and shall not disturb, annoy, endanger, or inconvenience neighbours, nor shall guest use the Property for any immoral, offensive or unlawful purposes, nor violate any law, association rules or ordinance, nor commit waste or nuisance on or about the Property.
DOWN PAYMENT/ DEPOSIT: A reservation can be made with a 25% down payment paid by credit card when the reservation is made. Full payment is charged 90 days prior to scheduled arrival date. If a check/cheque (payable to Ellis Exclusive Villas) or money order is not received by the due date, the balance will be charged to your credit card. The credit card must have an expiration date that extends beyond your stay.
If a reservation is made less than 90 days prior to arrival, full payment is due when the reservation is made.
If the guest has no Visa, Master Card, or Discover Card, a cash payment can be arranged which will include an additional $500 refundable security deposit. This security deposit will be returned within one week of the departure date, provided there is no breakage or damage to the premises and/or contents, there are no outstanding long distance phone or pay-per-view charges, no additional cleaning costs, and all other rules of this agreement are adhered to. A $35.00 service charge will be incurred for any returned checks.
BALANCE PAYMENT: If no other payment is received 90 days prior to arrival, we will automatically charge the balance to the credit card on file. Balance is due no later than 90 days prior to your arrival date. We can keep the balance payment on the same credit card used for the initial payment, you can call with a different card, or a check/cheque or money order can be issued at least 90 days prior to your arrival. Please send your check/cheque or money order with a signed copy of the rental agreement.

DAMAGE POLICY: Every guest must take out a $65 damage protection policy (“Vacation Rental Damage Plan”) through Ellis Exclusive Villas. This Vacation Rental Damage plan covers unintentional damages to the vacation property’s interior that occur during your stay, provided they are disclosed to management prior to checkout. The policy will pay a maximum benefit of $500. Any damages that exceed $500 will be charged to the credit card on file. Certain terms and conditions apply.
You can purchase a vacation rental damage plan at the time of reservation, or any time before check-in, but not after your arrival.
The Damage Waiver Insurance will cover you for stains on the carpet, marks on the wall, broken dishes, stained or damaged towels, and other small damages. It does not cover negligence or gross intentional damage to the property. Nor does it cover theft.
Even if you choose to take out the protection plan, we will still require your credit card information. If damage does occur, your card will not be charged. The only times the card would be charged is if the damage is negligent, or for gross intentional damage, or damages that exceed $500. Guests who purchase the protection plan must report any damages discovered upon arrival. If damages occur, guests must contact Ellis Exclusive Villas and report the damage immediately. Failure to do so will void the protection plan.
We must make any claim before you vacate the property or the Insurer will not cover the cost of the damage incurred so it is vital that you report any damages to Ellis Exclusive Villas immediately. If the cost of the damage cannot be recovered through your Vacation Rental Damage Plan you will be liable for the cost of replacement or repair.
As a condition to the rental of all vacation properties, Ellis Exclusive Villas reserves the right to charge the Guest’s credit card for any and all uncovered Guest/Invitee caused losses and damages sustained to the vacation property throughout the duration of their period of occupancy. In the event of any uncovered Guest/Invitee-caused loss or damage to the vacation property, including, but not limited to, undue cleaning, eviction, service calls, service charges, fines/assessments, repairs or replacements, plus all applicable taxes, Ellis Exclusive Villas reserves the right to charge the guest’s credit card. An itemized statement outlining all associated costs will be sent via regular or electronic mail to the address submitted by the guest at the time of booking. By written or electronic endorsement of this agreement, the guest hereby agrees to pay for all such charges.
CANCELLATION: The guest may cancel their booking at any time up to or during the rental period. In the event that the guest exercises their right to cancel, we will levy the following cancellation rates as a proportion of the total rental fee.
25% when cancelling 91 days or more before your check-in date, plus a cancellation fee of $20
100% when cancelling 90 days or fewer before your check-in date, plus a cancellation fee of $20
In the unlikely event that circumstances beyond the reasonable control of the owners necessitate the cancellation of the booking, the owners reserve the right to cancel the booking at any time and shall only be liable to refund the monies already paid by the guest, or make alternative arrangements by agreement with the guest. If this should happen Ellis Exclusive Villas will do our best to relocate you to another vacation home of the same standard or upgrade you free of charge.
If we are forced to move your reservation due to a calendar not being updated, or due to unforeseen circumstances, we retain the right to move your reservation, penalty free, into another home of similar size and standard. Judgment on whether the home is comparable will be the sole discretion of Ellis Exclusive Villas.
POWER/ WEATHER RELATED CANCELLATION: Ellis Exclusive Villas does NOT issue refunds due to acts of nature such as: weather, road conditions, storm damage or power outages, and we recommend ensuring you have adequate insurance cover to protect you against these instances.
MARKETING: By booking with Ellis Exclusive Villas, you accept that you are giving implied consent for Ellis Exclusive Villas to send you marketing communications including signing up to our newsletters and blog. If you do not wish to receive such marketing communications, please use the opt-out options offered within those communications.
UPON ARRIVAL: Take a look around the property. If there are concerns or issues with your vacation property, please immediately contact our office (leave a message if there is no answer). No refunds or considerations are given unless were notified of problems during your stay. Please let us know about any and all pre-existing damage in order to ensure that you won’t be held responsible. It is essential that you inform us immediately about any damage that happens during your stay (in order for it to be covered by your Vacation Rental Damage Plan insurance).
If you do not follow these instructions, then you cannot dispute Ellis Exclusive Villa’s final damage report.
EMERGENCIES/ MAINTENANCE: In the event of a problem accessing the vacation property or if there are problems with condition or amenities of the vacation property, please immediately contact the Ellis Exclusive Villas office (leave a voice message and send a text message if there is no answer).

ARRIVAL TIME: Check in is at 4 pm. A very early arrival may be arranged (for between $75 and $135, depending on the property), pending other reservations and the housekeeping schedule. Please contact us within 24 hours of your arrival to make these arrangements. Unless you have specifically arranged for an early arrival time, please do not arrive at the property before your scheduled check-in time.
DEPARTURE TIME: Check out is at 10 am. Your prompt departure is appreciated so we can prepare the vacation property for any incoming guests. A very late departure may be arranged (for between $75 and $135, depending on the property), pending other reservations and the housekeeping schedule. If you have not arranged for a late check out, you may be charged $35 for each hour or part thereof beyond 10 am that you are still on property, at a minimum of one hour. If the vacation property has not been vacated by 4 pm, a fee equal to the rental rate of 2 ½ days may be assessed.
CHANGE IN NUMBER OF GUESTS/ CONDUCT OF GUESTS: The guest must ensure that there will be NO more than the number of people stated on the reservation form occupying the vacation property. Unauthorized people at the vacation property at any time will result in a double charge for each additional guest or a maximum occupancy charge (whichever is more), and loss of any security deposit, in addition to any and all damage, disturbance, and cleaning charges.
The vacation property is not intended for parties, nor gatherings at any time of anyone except those who have paid to occupy the property. Exceptions may be made on an individual basis – please contact Ellis Exclusive Villas for prior approval.
If there is excessive noise or music, any illegal activity, or evidence of violation of these policies, you may be asked to vacate the premise without any refund and additional charges may be levied. Please inform us of any change in the number of guests before your arrival to avoid these charges and so the vacation property can be prepared appropriately for your group. No exceptions or refunds are given for changes in the number of guests after your arrival.
CLEANING FEE(S): A non-refundable cleaning fee is required with all reservations. This fee is for our housekeepers who dust, vacuum, sanitize, clean linens and towels, maintain the hot tub and remove refuse from the property. Guest(s) are required to follow all check out procedures detailed in this agreement and leave the property in the same general and good habitable condition it was in when the Guest(s) arrived. Undue and/or unreasonable cleaning of the vacation property shall be charged to the Guest’s/Cardholder’s credit card as an Additional Cleaning Charge at a rate of up to $45/hour, with a one hour minimum. This also applies to the property exterior, grounds, BBQs and hot tubs (if so equipped).
CLEANING: A starter supply of expendable supplies such as paper goods and soap is provided; please be prepared to bring or purchase additional supplies if you feel this will not be adequate. Alternatively, Ellis Exclusive Villas can arrange for a basket of toiletries for you at the property for a small additional fee. Housekeeping is not provided during your stay unless previously arranged. Failure to comply with pre-departure cleaning requirements resulting in excessive cleaning will be charged to your credit card at $45/hour, with a one-hour minimum.
PRE-DEPARTURE CLEANING REQUIREMENTS:
1) Place soiled towels in the bathtub.
2) All dirty dishes, cookware and eating utensils should be washed, rinsed, dried and put away in the proper location.
3) Floors should be in generally good condition and ready to be vacuumed by our housekeepers.
4) All household trash, garbage, recycling and/or other discarded items should be properly bagged up so as to avoid spillage/leakage, and deposited in the proper refuse containers provided. Please do your best to help us recycle by hauling it out with you. Many properties are in lakeside locations and wildlife abounds – therefore, under NO circumstances should household refuse be deposited and/or otherwise left unsecured outside or additional charges may apply. Pick-up of household refuse can be arranged for extended stays.
5) Refrigerator and microwave should be left clean and free of food.
6) All appliances (stove, oven, BBQ, etc.) should be left in a clean condition and free of spills and grease.
7) Please wipe down counters and other surfaces.
8) All litter must be picked up from the premises and placed in the outside garbage cans, tied securely in trash bags.
9) GLITTER AND CONFETTI ARE NOT ALLOWED AT ANY PROPERTY, INSIDE OR OUTSIDE.
LINENS & TOWELS: Linens and towels are provided for use inside the vacation property. In some properties, pool towels are also provided. Bring items that you may need for pool use or away from the property. Extra sheets and towels can be provided on request. Ellis Exclusive Villas also offers supplementary housekeeping services which are available on request for a small fee. Prices start at $45 per day. If you would like to use these housekeeping services, please call for a quote.
SMOKING: Smoking is NOT permitted inside any Ellis Exclusive Villas property. Smoking is allowed outside as long as butts and ashes are not left behind. Discard the butts and ashes in the outside garbage. Do not throw butts on the ground (including the BBQ if so equipped) or bring them into the property. If there is any tobacco smell in the property after your departure, there will be a minimum $250 charge. Oil lamps and incense are not permitted due to the long-lasting odour. If these policies are violated, there will be a charge for excessive cleaning.
SATELLITE TV, INTERNET & PHONE CALLS: All properties are privately owned and have different subscription packages for cable and/or satellite and internet. Ellis Exclusive Villas does not guarantee any programs, events or reception. The guest is liable for ordering any Pay Per View – if the guest does not use their own credit card for ordering, programming charges plus an additional $5.00 processing fee will be charged to the credit card we have on file. Some properties are equipped with a telephone; short calls within the U.S. are permitted.
PETS: Pets are allowed in designated pet-friendly homes, provided the applicable pet fees have been paid. Unauthorized occupancy of pets will result in immediate eviction and loss of all rents and deposits. Please ensure pet hair is removed from surfaces and furniture before departure. Any excess cleaning resulting from pet occupancy will be charged at $45 per hour.
PARKING: Parking is limited to 2 vehicles (unless otherwise stated). Vehicles are to be parked on the drive only. Parking on the road or grass is not permitted. Any illegally parked cars are subject to towing. Applicable fines or towing fees are the sole responsibility of the vehicle owner.
GRILLS/BBQs: Grills/BBQs should only be used outside the screened pool enclosure. Guests are solely responsible for any damages resulting from the misuse of grills/BBQs. It is the responsibility of the guest to ensure that grills/BBQs are left clean. If not, a charge of $75 will be made to the guest’s credit card.
EXCESS TRASH: Guests are responsible for taking trash cans/ rubbish bins out on the appropriate collection days and disposing of trash/ rubbish responsibly throughout their holiday. Excess trash left at the property following departure may result in the guest’s credit card being charged an excess trash fee of $75.
POOL SAFETY: There must be a responsible adult in the pool area to supervise children. Glass and breakable crockery must not be taken into the pool or surrounding deck/patio area. The pool is not is not designed for diving and this activity is dangerous and therefore not permitted. Safety signs are posted at various locations in and around the home and must be adhered to.
POOL HEAT: Pool Heat, at $30 / £20 per day, is an optional extra. It is, however, recommended between November and March. Pool Heat is designed to take the chill off the water and not to heat the pool to the temperature of bath water. A sudden drop in climate temperature will affect the pool heat. Ellis Exclusive Villas will not be liable for changes in climate or their subsequent effects on pool heat.
Pool heat will automatically shut off if the temperature drops below 50 degrees Fahrenheit. The property management team cannot override this because it is a security measure to prevent the pool pump breaking. Refunds will not be given if this occurs.
If pool heat is not working correctly, please contact our onsite management team. If the pool heater is broken then a refund will be given for the number of days the guest is without this service. We must be informed of this issue as soon as it occurs. Refunds will not be given when pool heat issues are brought to our attention after the stay.
Pool heat is set between 83F-85F. We will not be able to adjust the pool heat. If you arrive and the temperature is in this range and this is not comfortable for you, then the only option is to turn the pool heat off and a refund will be given for the unused days.
If the home has a jacuzzi/spa you must purchase pool heat for it to be warm. The jacuzzi/spa is only heated by the pool heater. The pool heater pump operates approx. 8-10 hours a day. If you request pool heat the day of arrival or whilst on vacation, there will be an additional $45 call out fee.
HOT TUB USE & RULES: Use of the hot tub is strictly at your own risk and liability. Our housekeepers sanitize and replenish chemicals in all hot tubs prior to your arrival. If additional maintenance is required during your stay, or the next guests are unable to use the tub due to conditions resulting from your failure to observe the following rules, there will be a $45 charge (and cost of supplies if necessary) for each hour of required maintenance. Instructions for the tub controls are posted at the hot tub or we will be happy to help you. A $10 refund per night will be given if you are unable to use the hot tub due to malfunction not caused by you or your guests.
1) Always shower or bathe BEFORE using the hot tub. Body oil, makeup, hair products, etc. clog filters and you will be liable for any damage caused in this way.
2) An adult must always accompany children.
3) Observe the safety precautions posted at the tub and have all guests do likewise.
4) Do not sit, stand or lie on the tub cover; a $300 charge will be made if the cover is broken this way.
5) Unhook the safety strap before removing the cover.
6) Replace cover and thermal blanket (where provided) when you are not in the tub and secure the safety strap to conserve heat, for safety, and to keep debris out of the water.
7) If temperature has been adjusted during use, MAKE SURE to return the temperature to the original setting when done. Failure to reset may cause the hot tub to overheat and stop working, possibly resulting in additional charges.
8) Use non-breakable drink containers in the tub area.
9) DO NOT ADD ANYTHING TO THE HOT TUB WATER such as bubble bath & oils, even if they say they are compatible.
10) If the water level is low (below the filter intake) add more water or call, as low water can destroy the pump, resulting in additional charges.
11) If the water looks cloudy or dirty, please do not use the hot tub and call us immediately. If it is found that the service is necessary due to guest abuse, the guest will be responsible for the charges.
LEFT ITEMS/LOST PROPERTY: Please check carefully for belongings before you leave. Left items can be mailed to you if requested and you will be charged shipping costs plus a $10 service fee. Pick up may also be arranged at our Kissimmee office. Ellis Exclusive Villas is not responsible for lost or stolen items.
RECEIVING GOODS OR OTHER DELIVERIES AT THE VACATION HOME: If the guest chooses to arrange delivery of any goods to the vacation home this is entirely at the guest’s own risk. Ellis Exclusive Villas accepts no responsibility for any deliveries, goods or packages that go missing. Please note the section pertaining to excess trash earlier in this agreement.
RIGHT OF ENTRY: The guest agrees that Ellis Exclusive Villas reserves the right to enter the vacation property any time to investigate disturbances, check occupancy, check for damage, to make such repairs, alterations or improvements as we may deem appropriate, or to show the property to prospective purchasers or guests (in which case prior notification will be given).
TREATMENT OF ELLIS EXCLUSIVE VILLAS STAFF: We believe that our staff should be free to work without racism or other prejudice, aggression, violence, abuse or the threat of violence or abuse. We therefore operate a zero tolerance approach to these behaviours. Anyone found to be treating Ellis Exclusive Villas staff or the staff of our contractors or partners in such a manner will be deemed to be in breach of this contract and will be asked to vacate the vacation home with immediate effect with no refund given.
SECURITY & SAFETY RISKS: ALWAYS LOCK DOORS AND WINDOWS WHEN YOU LEAVE THE PROPERTY. When you rent the vacation property, you assume responsibility for it and its contents, as well as your personal property. Always lock the doors and windows when you leave the vacation property. There is a key safe to which you will be given a code. This code is changed with every guest for security. Guest is responsible for lost key replacement costs. Children are welcome, but there are conditions in and around the home that may pose hazardous to them, as well as to adults, such as the pool, nearby lakes, open stairways, wildlife, heat and BBQs. Children must be supervised at all times. Please keep them safe. Ellis Exclusive Villas does not assume any responsibility for injuries resulting from your failure to use due caution. Candles are not allowed due to fire hazard except citronella candles in buckets outside, or supplied emergency candles in the case of a power outage.
CLIMATE: The guest is hereby made aware that Florida is a tropical climate and it is the home of many insects, etc. All homes are treated on a regular basis to repel such unwanted visitors but inevitably, they occasionally will find their way inside properties from time to time. They are best eradicated by spraying with an appropriate product.
FALSIFIED BOOKINGS: Any bookings obtained under false pretences will be subject to forfeiture of advance payment, deposit and/or rental money and the guest’s party will not be permitted to enter the property.
PROBLEMS / COMPLAINTS: Any complaint related to the accommodation must be made in writing to Ellis Exclusive Villas within 24 hours of any problem arising. Ellis Exclusive Villas will endeavour to put things right. Unless there is a valid reason, Ellis Exclusive Villas is not liable for any complaint that was not initially registered with Ellis Exclusive Villas by the guest during their stay.
The guest is hereby made aware that there may be other homes and/or roads under construction in the area. Ellis Exclusive Villas will not accept liability for complaints arising from construction, traffic or noise. Neither the home owner nor Ellis Exclusive Villas shall be liable for any loss or delay caused by conditions over which they have no control. Neither the home owner nor Ellis Exclusive Villas shall be liable for any loss or disturbance due to noise or disturbances from anywhere within the vicinity of the rental property.
INSURANCE: It is the guest’s responsibility and a condition of booking (as it is with almost every holiday company) to ensure that you have adequate insurance cover in place. Such insurance will ensure that you are properly covered against unexpected cancelation charges, medical costs that might be incurred while you are away, loss of money, or belongings, or personal liability claims. Please note that the cover offered by most credit card companies is rarely adequate for package holiday or holiday flight bookings.
DOCUMENTATION: It is your responsibility to obtain all documents required for your holiday, to ensure that these are in proper order and to take them with you. Guests are ultimately responsible for arranging, and must be in possession of, a valid passport and any visas and vaccination certificates required for the duration of their holiday. Information about these matters or related items (climate, clothing, baggage, etc.) is given in good faith but without responsibility on the part of Ellis Exclusive Villas. Ellis Exclusive Villas will not be liable if you fail to obtain and carry the appropriate documentation and you will be responsible for meeting any additional costs incurred by reason of such failure.
INDEMNIFICATION & HOLD HARMLESS: While Ellis Exclusive Villas and its property owners strive to maintain vacation properties in the finest condition, no guarantees are expressed nor implied regarding suitability or for any particular purpose. All guests and their invitees use the vacation property structures and premises at their own risk.
Ellis Exclusive Villas and its property owners shall not be held liable or otherwise responsible in any way for injury to any guest and/or their invitees that is caused or permitted to be caused by the intentional or unintentional acts of said guest(s) and/or invitees, or by the failure of structures, appliances, (including hot tubs and BBQs) furnishings, and/or other equipment, whether by malfunction, misuse, acts of God/nature, and/or are otherwise naturally occurring. No guarantees are expressed nor implied as to the suitability of utilities and other services provided to the vacation properties and adjacent structures and premises. No guarantees are expressed nor implied regarding the suitability/compatibility of materials utilized in the construction of the vacation property and/or its contents.
Ellis Exclusive Villas and its property owners shall not be held liable nor otherwise responsible in any way for allergic reactions to guest(s) or invitees, caused or permitted to be caused by materials utilized in the manufacture of the vacation property and/or its contents, nor from mould and/or airborne spores, nor from pet/animal allergens, nor from chemical agents including, but not limited to appliances, linens, carpeting, utensils, fixtures, hot tubs, and/or other equipment. The guest and invitees hereby agree to forever hold harmless and indemnify Ellis Exclusive Villas and its property owners from and against all claims, demands, loss, liability/responsibility of any kind and character, including cost of defence, arising out of or in any way connected with the guest’s use of the property.
FORCE MAJEURE: No liability is accepted, or refunds given, for events which are “force majeure”. These include, but are not limited to: war, threat of war, riots, civil commotion, terrorist activities, industrial disputes, technical difficulties with transportation, natural or nuclear disaster, fire, adverse weather conditions and/or other events outside our control.
LIABILITY: Ellis Exclusive Villas accept no liability whatsoever for any injury or loss sustained by guests or any other visitors while in the home or swimming pool. No responsibility is accepted for any death, illness, loss or damage to property and/or motor vehicles.
Due to our strict cancellation policy, guests are advised to ensure that they have adequate travel insurance to cover cancellation, illness, personal loss, or injury, or any loss or theft of luggage or personal property. It is the guests’ responsibility to ensure all travellers are in possession of valid passports and any appropriate visa.
